On May 30, 2019, the Nebraska Hemp Farming Act (LB 657) was signed into law by Republican Gov. Pete Ricketts, bringing Nebraska's cannabis and hemp laws in line with the 2018 Farm Bill. CBD oil produced from a cannabis or hemp plant that contains less than 0.3 percent THC is legal under both the Farm Bill and the Nebraska Hemp Farming Act. The state of Nebraska has already passed a hemp agricultural pilot program, which lets state agencies and universities produce industrial hemp under a limited pilot program. The Farm Bill mandated that the Department of Agriculture must submit guidelines for hemp cultivation to the federal government for approval. While the Nebraska Hemp Farming Act doesn't name CBD explicitly, it does state that legitimate hemp includes any derivative, extract, or cannabinoid with less than 0.3% THC. Because of the subtle ambiguity in the text, some potential CBD vendors and lawmakers are uncertain if CBD is entirely legal under the new rules. Prior to the passage of the Nebraska Hemp Farming Act, Republican Attorney General Doug Peterson issued a memo stating that CBD was still categorized as a Schedule 1 substance by the state despite being in an FDA-approved drug or authorized by UNMC. In September 2019, after the hemp farming bill was passed, there has been no update from the attorney general on whether or not he will change his position.
