West Virginia CBD laws

In 2018, the West Virginia Legislature passed legislation legalizing hemp farming for industrial purposes under the West Virginia Industrial Hemp Development Act. After the 2018 U.S. Farm Bill was enacted, West Virginia's laws regarding hemp cultivation, processing, and sale were updated to comply with federal law. After the introduction of hemp farming in states where it was previously banned, West Virginia lawmakers passed House Bill 2694 to define licensing standards for hemp production, as well as the transportation and storage of industrial hemp. The legislation makes it clear that:
  • Hemp with a THC content of less than 0.3 percent is an agricultural product.
  • No license is necessary to possess, utilize, transport, or sell hemp-derived cannabinoids like CBD.
  • Hemp-derived CBD is not a controlled substance or an adulterant.
  • CBD products intended for ingestion are classified as food rather than controlled substances.
West Virginia allows hemp and CBD items produced in other states to be sold, as long as they are consistent with state regulations. The bill would also offer protection to those who use CBD or other cannabis compounds for health reasons, such as chronic pain. This is not the case yet; however, because federal law still prohibits their sale and possession.
