 2. Wisconsin CBD laws

In 2014, the use of cannabidiol oil for medical purposes was legalized in Wisconsin. CBD oil was legalized under Lydia's Law (also known as the Wisconsin Act 267), which established stringent medical requirements. It was allowed just for individuals suffering from seizure disorders. CBD oil became legal in Wisconsin in 2017, when Scott Walker, a Republican governor, signed SB 10 into law. CBD oil was approved by the state Senate with 31-1 support and was introduced in the Senate. The bill allowed individuals to possess CBD oil with the permission of their doctors. SB 10 had the foresight to require the state government to follow federal law if and when CBD oil was rescheduled at the federal level. In March 2017, the Wisconsin Assembly passed AB 49, which is SB 10's companion bill by a unanimous vote of 98-0, relaxing CBD restrictions. One year after the signing of the 2018 US Farm Bill, Wisconsin amended its CBD laws. Wisconsin law aligned with the federal law, allowing the cultivation of industrial hemp. The state of Wisconsin has a pilot program for industrial hemp, which was started in Senate Bill 188. The program allowed the production, processing, sale, and consumption of hemp-derived items including CBD oil. The Farm Bill, which extended the state's industrial hemp program and included a provision to legalize marijuana for research purposes, was scheduled to expire on October 31, 2020. However, on October 1, 2020, Section 122 of the Continuing Appropriations Act extended the industrial hemp program. It's worth noting that the FDA hasn't given a clear answer on how or when it will change its regulations to allow CBD or CBD oil in food or dietary supplements. The only type of CBD that has been authorized by the FDA is Epidiolex, a seizure medication produced by G.W. Pharmaceuticals.

Licensing Requirements

Growers and processors must acquire one-time licenses and re-register on a yearly basis to harvest industrial hemp. They may get these licenses from the Wisconsin Department of Agriculture, Trade, and Consumer Protection (DATC). The DATC just issues licenses to people who have completed the background checks. The applicant must pay licensing and annual registration charges, as well as submit various applications and agreements. Growers and processors are the only ones who need a CBD license. Retailers may legally sell hemp-derived CBD products without a DATC license.

Medical Cannabis in Wisconsin

Under the new law, patients with a valid medical marijuana card are eligible for CBD oil. It's not entirely clear what types of marijuana are permitted under the legislation. The possession of THC is typically prohibited by state statute, and this bill creates an exemption for certain patients who have "cannabidiol in a form without a psychoactive effect." For purposes of gaining cannabidiol, qualified patients are not allowed to grow their own non-psychoactive marijuana strains. Cannabidiol may be possessed by individuals suffering from seizure disorders only in a form that is not psychoactive, according to the law. Any individual with a letter from their doctor, as amended in 2017, may use and possess cannabidiol.

Adults 18 and older with a medical CBD prescription in Wisconsin do not face any limit on their possession. If you have medical documentation to treat a qualifying condition, according to 961.32(2m) (b), you can possess CBD without any THC.
